Agreement Requirements
- You must be at least 16 years old to use our services
- If under 18, you must have parental or guardian consent

Organizational Accounts
If you're using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Continued Use

User Accounts
Account Creation

- One person or organization may maintain only one account

Account Responsibilities
- Keep your profile information current and accurate

User Conduct
Acceptable Use
- Use the platform for legitimate community development purposes
- Respect the rights, privacy, and dignity of all community members
- Contribute constructively to discussions and collaborations
- Follow all applicable laws and regulations

Prohibited Activities
- Harassment: Bullying, threatening, or intimidating other users

- System Abuse: Attempting to hack, disrupt, or overload our systems

Content & Intellectual Property
Your Content
- You retain ownership of content you create and share on the platform
- You grant the Platform a license to use your content to provide our services
- You represent that you have the right to share all content you upload
- You are responsible for ensuring your content doesn't infringe on others' rights
- When publishing, you must select an accurate content license; Traditional Knowledge and community-restricted licenses require FPIC affirmation (Cultural Protocols)
Content License
By sharing content on the Platform, you grant us a non-exclusive, worldwide, royalty-free license to:
- Display and distribute your content on the platform
- Create derivative works for platform functionality (e.g., thumbnails, previews)
- Use your content in aggregated analytics and research
- Include your content in promotional materials (with attribution)
Additional reuse by other users is governed by the license you select at publish time (e.g., Creative Commons, commercial, all-rights-reserved, Traditional Knowledge).
Platform Content
- Character Developer software, frameworks, design systems, APIs, schemas, scoring models, and editorial materials are proprietary to Modern Ancients — see our Copyright Notice
- Our content is protected by copyright, trademark, and other intellectual property laws
- You may not copy, modify, scrape for model training, or distribute our proprietary content without permission
- Third-party open-source components bundled with the Service remain under their own licenses
- Brand marks are governed by our Trademark Notice
DMCA Policy
We comply with the Digital Millennium Copyright Act (17 U.S.C. §512), including notice-and-takedown, counter-notification, and a repeat-infringer termination policy. Full procedures, designated agent details, and the report form are at /dmca.
Cultural & Indigenous Intellectual Property
Sacred sites, ceremonial materials, and Traditional Knowledge are subject to our Cultural Protocols, including FPIC, community veto, and expedited cultural takedown — in addition to copyright law.
Payment Terms
Subscription Plans
- Community (Free): Basic features for individual community members
- Organization ($49/month): Advanced tools for community organizations
- Enterprise (Custom): Full platform access with dedicated support
Billing Terms
- Subscriptions are billed monthly or annually in advance
- All fees are non-refundable except as required by law
- Price changes will be communicated 30 days in advance
- Failed payments may result in service suspension
- You can cancel your subscription at any time
Free Trial
- New users receive a 14-day free trial of Organization features
- No credit card required for trial activation
- Trial automatically converts to Community (free) plan unless upgraded
- One free trial per organization
Taxes
You are responsible for any applicable taxes, duties, or government fees. We will add applicable sales tax to your invoice where required by law.
Liability & Disclaimers
Service Disclaimers
- This Service is provided "as is" without warranties of any kind
- We do not guarantee that the service will be uninterrupted or error-free
- We are not responsible for user-generated content or third-party services
- Location data and AR features may not always be accurate
Limitation of Liability
To the maximum extent permitted by law, the Platform shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages resulting from user content or third-party actions
- Any damages exceeding the amount paid for our services in the past 12 months
Indemnification
You agree to indemnify and hold the Platform harmless from any claims, damages, or expenses arising from your use of this Service, violation of these terms, or infringement of any rights.
Important Note
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by law.
Termination
Termination by You
- You may terminate your account at any time through your account settings
- Cancellation takes effect at the end of your current billing period
- You can export your data before termination
- Some content may remain visible in community contexts after termination
Termination by the Platform
We may terminate or suspend your account if you:
- Violate these Terms of Service or our Community Guidelines
- Accumulate repeat copyright infringement strikes under our DMCA Policy
- Engage in illegal activities or harmful behavior
- Fail to pay required fees after notice and opportunity to cure
- Create security risks or technical problems
Effect of Termination
- Your access to the platform will be immediately suspended
- Your personal data will be deleted according to our Privacy Policy
- Community contributions may remain for historical purposes
- Outstanding fees remain due and payable
Data Export
Before termination, you can request an export of your personal data. We will provide this in a standard format within 30 days of your request.
Terms Updates
We may update these Terms of Service to reflect changes in our services, legal requirements, or business practices. We will notify you of significant changes through:
- Email notification to your registered address
- Prominent notice on our platform
- In-app notifications for material changes
- 30-day advance notice for changes that affect your rights

Legal Information
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Dispute Resolution

- Arbitration will be conducted under the rules of the American Arbitration Association
- Class action lawsuits are waived except where prohibited by law
Severability
