DMCA Copyright Policy

Character Developer hosts user-generated and third-party content. We respect intellectual property rights and expect users to do the same. This policy describes our notice-and-takedown process under the Digital Millennium Copyright Act (DMCA).

Pursuant to 17 U.S.C. §512(c)(2), Modern Ancients designates the following agent to receive notifications of claimed infringement:

We intend to maintain registration of this designated agent with the U.S. Copyright Office DMCA Designated Agent Directory. Until registration is confirmed, use the contact information above for all statutory notices.

To be effective under §512(c)(3), a written notification must include substantially the following:

1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner
2. Identification of the copyrighted work claimed to have been infringed (or a representative list)
3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate it (URL, listing ID, or screenshot)
4. Your mailing address, telephone number, and email address
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

You may also submit a structured notice via our DMCA report form. Incomplete notices may delay processing.

If your content was removed and you believe it was a mistake or misidentification, you may file a counter-notification under §512(g) containing:

1. Your physical or electronic signature
2. Identification of the material removed and the location where it appeared before removal
3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or for non-U.S. residents, any judicial district in which Modern Ancients may be found), and that you will accept service of process from the person who provided the original notification

Upon receipt of a valid counter-notice, we may restore the material in approximately 10–14 business days unless the copyright claimant files an action seeking a court order.

Consistent with §512(i), we terminate, in appropriate circumstances, accounts of users who are repeat copyright infringers.

• Strike 1: Content removed; written warning; education on acceptable use
• Strike 2: Temporary suspension (minimum 14 days) and review of remaining uploads
• Strike 3: Account termination and permanent ban from republishing the same material

We may accelerate termination for egregious or commercial-scale infringement. Strikes generally expire after 24 months of good standing unless a court order or settlement provides otherwise.

Character Developer acts as a service provider hosting content at the direction of users. We do not independently verify every upload for copyright status. Upon valid notice, we expeditiously remove or disable access to allegedly infringing material and notify the affected user when practicable.
